"I’d like to thank my family for loving me and taking care of me. And the rest of the world can kiss my ass.”

After the murder nun in Amarillo, Texas, police are convinced they found their killer. Johnny Frank Garrett was tried, sentenced, and executed for the murder of Sister Tadea Benz, but this case is not as straightforward as it seems. From the misconduct of a medical examiner, calls for clemency from Pope John Paul II, omitted evidence, and a second murder that police knew was tied to Sister Tadea's, this is a case where nothing is as it seems. The murders of two women were a rabbit hole that concluded with the realization that Johnny Frank Garrett was executed for a crime he probably didn't commit. This is the story that inspired a movie and three people who were victims of a killer and the justice system.

1
00:00:00.280 --> 00:00:04.000
Hi guys. I'm Courtney and I'm Lisa, and welcome to

2
00:00:04.040 --> 00:00:06.599
the next chapter in the Book of the Dead, brought

3
00:00:06.599 --> 00:00:30.920
to you by Dark Cast Network indie Podcasts with a Twist. Hello, Hello,

4
00:00:31.480 --> 00:00:34.119
Welcome to the Halloween episode of the Book of the Dead.

5
00:00:35.119 --> 00:00:38.560
I have a surprise for you. Guess who's back.

6
00:00:39.399 --> 00:00:41.920
I think she's referring to me, Although that's probably not

7
00:00:41.960 --> 00:00:43.159
a good surprise for some of you.

8
00:00:43.920 --> 00:00:45.320
I'm going to get it out of the way now

9
00:00:45.359 --> 00:00:47.439
because I already know people are going to ask, because

10
00:00:47.439 --> 00:00:50.039
people have asked, how are you feeling.

11
00:00:51.320 --> 00:00:53.079
I am feeling better. I did have a little bit

12
00:00:53.119 --> 00:00:58.320
of some medical issues I had to deal with, still

13
00:00:58.439 --> 00:01:04.560
dealing with one, but I am totally fine, will be fine.

14
00:01:04.920 --> 00:01:07.519
Just I guess irritated that I have to do this.

15
00:01:08.159 --> 00:01:12.159
That makes sense, makes sense? Yeah, like I said, people

16
00:01:12.159 --> 00:01:14.400
were asking, I was very vague. Don't worry.

17
00:01:14.439 --> 00:01:16.000
I said, you got into a car accident, that you

18
00:01:16.000 --> 00:01:18.040
were okay. It wasn't like a serious car accident, but

19
00:01:18.120 --> 00:01:20.599
you were dealing with things because of set car accident.

20
00:01:20.879 --> 00:01:24.760
Yes, we're going to jump right in now. Just everybody,

21
00:01:24.799 --> 00:01:30.799
remember that I know nothing of this story at all, nothing,

22
00:01:31.599 --> 00:01:36.719
So my commentary or response, however you want to term

23
00:01:36.760 --> 00:01:41.599
it is a completely raw reaction. So I don't want,

24
00:01:41.840 --> 00:01:44.359
you know, anybody to think that I'm, I don't know,

25
00:01:44.599 --> 00:01:47.599
making up my response or have you.

26
00:01:47.879 --> 00:01:52.319
It's not scripted. It's what she's trying to say. Little refresh, heir.

27
00:01:52.599 --> 00:01:55.400
There you go, it's not scripted. Well, her responses aren't

28
00:01:55.400 --> 00:01:57.640
scripted obviously, like I have notes that I follow, But

29
00:01:57.719 --> 00:02:01.239
either way, we're gonna jump right in. So it's rare

30
00:02:01.280 --> 00:02:03.159
for me to cover a case where I have my

31
00:02:03.319 --> 00:02:06.439
doubts about the person convicted of the crime that was committed.

32
00:02:06.959 --> 00:02:09.080
In fact, the last time I covered a case where

33
00:02:09.120 --> 00:02:11.960
I had these reservations was when we covered the murder

34
00:02:12.000 --> 00:02:14.960
of the McStay family and I expressed some doubt that

35
00:02:15.039 --> 00:02:19.479
Chase Merritt was responsible for the family's murdyrs. You remember that, Yes,

36
00:02:19.560 --> 00:02:22.520
I do. So it's been a long time. That was

37
00:02:22.520 --> 00:02:23.199
two years ago.

38
00:02:23.240 --> 00:02:24.439
Now it's been that long.

39
00:02:24.719 --> 00:02:28.759
It has it's been two years since we covered that case. Now,

40
00:02:29.159 --> 00:02:31.520
the case I'm going to tell you about is similar

41
00:02:31.680 --> 00:02:35.719
in that someone who is potentially innocent was convicted. But

42
00:02:35.800 --> 00:02:38.360
the difference between the two cases is that there is

43
00:02:38.400 --> 00:02:41.560
someone out there who was convicted of a very similar

44
00:02:41.639 --> 00:02:44.919
crime that may have been responsible. In fact, this man

45
00:02:44.960 --> 00:02:49.960
allegedly claimed he was responsible and honestly in full transparency.

46
00:02:50.000 --> 00:02:52.840
The more I researched what happened, the more I'm inclined

47
00:02:52.879 --> 00:02:55.680
to believe that an innocent man was convicted for a

48
00:02:55.719 --> 00:02:59.680
crime he didn't commit. And this case didn't start out

49
00:02:59.680 --> 00:03:03.199
like that. At face value, it seems very cut dry.

50
00:03:03.479 --> 00:03:07.800
Someone was brutally murdered, a killer was found, the evidence

51
00:03:07.800 --> 00:03:11.039
seemed to support it, They go to trial, they're convicted.

52
00:03:11.759 --> 00:03:15.840
But digging deeper led me to an entirely different side

53
00:03:15.960 --> 00:03:20.479
of the story, one involving another murder and alleged cover up,

54
00:03:20.639 --> 00:03:23.919
the misconduct of a medical examiner, and the involvement of

55
00:03:24.000 --> 00:03:27.080
the pope. So these are the murders of Narnie Bryson

56
00:03:27.199 --> 00:03:28.680
and sister Tada Bents.

57
00:03:29.719 --> 00:03:33.000
Okay, I'm when you say sister you.

58
00:03:33.039 --> 00:03:35.000
Mean Anon yet.

59
00:03:35.439 --> 00:03:35.800
Okay.

60
00:03:36.319 --> 00:03:38.439
Now, before we can dive into the murders, we have

61
00:03:38.560 --> 00:03:41.319
to do a brief history lesson and talk about the

62
00:03:41.400 --> 00:03:44.120
Mariial boatlift of nineteen eighty. I don't know if you

63
00:03:44.240 --> 00:03:45.159
know anything.

64
00:03:44.800 --> 00:03:48.560
About that a little bit, not too much, okay, or

65
00:03:48.719 --> 00:03:50.120
not that I remember too much?

66
00:03:50.280 --> 00:03:55.759
Okay. So to give you a general overview. After the

67
00:03:55.879 --> 00:03:58.759
US trade embargo of nineteen sixty two, as well as

68
00:03:58.840 --> 00:04:02.199
various powers alone ligning themselves with the US, which pulled

69
00:04:02.199 --> 00:04:06.240
support from Cuba. During Fidel Castro's reign or presidency, I

70
00:04:06.240 --> 00:04:10.400
should say, Cuba's economy was crippled and many Cubans were

71
00:04:10.479 --> 00:04:14.520
vocal about seeking asylum. These asylum efforts started in nineteen

72
00:04:14.560 --> 00:04:19.079
seventy two and went on until nineteen eighty when Fidel Castro,

73
00:04:19.319 --> 00:04:23.920
furious with the descent of the Cuban people, surprisingly opened

74
00:04:24.000 --> 00:04:26.360
the border of the Port of Mariel, which was the

75
00:04:26.399 --> 00:04:30.399
closest port to the US, and said basically that anyone

76
00:04:30.439 --> 00:04:33.399
who wanted to leave, get out, and he did this

77
00:04:33.480 --> 00:04:37.639
on May first of nineteen eighty. They had six months now.

78
00:04:37.680 --> 00:04:41.439
He had said, according to history dot com quote, those

79
00:04:41.480 --> 00:04:45.519
who have no revolutionary genes, those who have no revolutionary blood,

80
00:04:45.680 --> 00:04:48.560
we do not want them, We do not need them.

81
00:04:49.199 --> 00:04:53.600
So one hundred and twenty five thousand people unchanged fled Cuba,

82
00:04:53.680 --> 00:04:56.240
and President Jimmy Carter said that they would be welcomed

83
00:04:56.240 --> 00:04:59.839
with open arms. He established the Cuban Haitian and tra

84
00:05:00.120 --> 00:05:04.360
program in June of nineteen eighty which granted temporary status

85
00:05:04.360 --> 00:05:08.040
and access to asylum, processing and community assistance to both

86
00:05:08.120 --> 00:05:11.920
Cubans and thousands of Haitians fleeing to the United States.

87
00:05:13.120 --> 00:05:17.199
So Fidel Castro took advantage of this and deported convicted criminals,

88
00:05:17.839 --> 00:05:21.720
mental hospital patients, sex workers, and members of the LGBTQ,

89
00:05:22.040 --> 00:05:25.000
and anyone else that Fidel Castro deemed to be less

90
00:05:25.079 --> 00:05:29.279
than He essentially said, Jimmy Carter, you wanted them so bad,

91
00:05:29.399 --> 00:05:32.199
you can have them. So of the one hundred and

92
00:05:32.240 --> 00:05:35.680
twenty five thousand plus people to arrive in Florida, over

93
00:05:35.759 --> 00:05:40.040
twenty thousand had a criminal record. Now, obviously, the Cuban

94
00:05:40.040 --> 00:05:43.480
and Haitian people that arrived in droves seeking political asylum

95
00:05:43.600 --> 00:05:46.600
weren't exactly welcomed with the open arms that Jimmy Carter

96
00:05:46.720 --> 00:05:50.439
claimed they would be, And that's something that would take

97
00:05:50.480 --> 00:05:53.920
an entire episode to delve into, but it was essentially

98
00:05:53.920 --> 00:05:57.560
because he said thirty five hundred people can be granted asylum,

99
00:05:57.959 --> 00:06:01.199
Fidel Castro won't know you could have every so they

100
00:06:01.240 --> 00:06:05.360
were vastly underprepared for the sheer volume of people that

101
00:06:05.480 --> 00:06:09.199
arrived in Florida. The reason I mentioned the boat lift

102
00:06:09.319 --> 00:06:11.759
is because as I said, it wasn't just people seeking

103
00:06:11.839 --> 00:06:15.800
asylum that came to the US, cast criminals as well,

104
00:06:15.839 --> 00:06:18.600
and some of them were incredibly violent, which will be

105
00:06:18.720 --> 00:06:23.839
relevant later. So in nineteen eighty one, in Amarillo, Texas,

106
00:06:24.000 --> 00:06:28.879
someone was prying on elderly women for months, from at

107
00:06:28.959 --> 00:06:32.920
least May until October. There were various attacks on women

108
00:06:33.040 --> 00:06:36.279
with ages ranging from mid to late seventies all the

109
00:06:36.319 --> 00:06:41.279
way into their nineties. While many of these women thankfully survived,

110
00:06:41.399 --> 00:06:44.560
at least two were killed after being brutally beaten and

111
00:06:44.800 --> 00:06:49.000
violently sexually assaulted. One was left in a coma for

112
00:06:49.079 --> 00:06:52.000
a brief time. And it's obvious to anyone that these

113
00:06:52.040 --> 00:06:56.439
are horrific crimps. It's obvious, but it seems as if

114
00:06:56.480 --> 00:06:59.560
the attacks were spread far enough apart that police didn't

115
00:06:59.600 --> 00:07:04.360
see connection, and the citizens of Amarillo weren't fearful of

116
00:07:04.399 --> 00:07:08.160
a violent person on the loose habitually committing these atrocities.

117
00:07:09.040 --> 00:07:10.839
Was it out in the papers and whatnot?

118
00:07:11.199 --> 00:07:15.240
It was, but it wasn't like they weren't so close together,

119
00:07:15.439 --> 00:07:18.319
Like one woman was attacked save this week, and then

120
00:07:18.360 --> 00:07:22.920
a few weeks later someone else was attacked. Like looking

121
00:07:22.959 --> 00:07:25.600
back on it now, it seems very obvious that someone

122
00:07:25.639 --> 00:07:29.160
was praying on these women, but at the time I

123
00:07:29.199 --> 00:07:32.079
don't think they realized that it was all connected. It

124
00:07:32.120 --> 00:07:35.319
was kind of a this is a terrible coincidence that

125
00:07:35.360 --> 00:07:38.000
all of these women are being attacked, but we don't

126
00:07:38.040 --> 00:07:39.639
think there's like a maniac on the loose.

127
00:07:40.199 --> 00:07:44.279
Okay it if it was spaced out, maybe they didn't

128
00:07:44.319 --> 00:07:45.079
make the connection.

129
00:07:46.079 --> 00:07:48.800
So. On July ninth of nineteen eighty one, the body

130
00:07:48.879 --> 00:07:51.680
of seventy seven year old Narnie Bryson was found in

131
00:07:51.720 --> 00:07:54.160
the home where she lived alone at seven thirty two

132
00:07:54.319 --> 00:07:59.079
North Houston Hill in Amarillo Now. According to an affidavit

133
00:07:59.160 --> 00:08:02.879
signed by officer Kenny Dockery, Narnie was found nude in

134
00:08:02.920 --> 00:08:07.560
her bedroom. The autopsy findings included numerous broken bones, evidence

135
00:08:07.600 --> 00:08:12.959
of genital trauma, and markings indicative of strangulation. The cause

136
00:08:13.000 --> 00:08:16.240
of death was determined to be asphyxiation due to strangulation,

137
00:08:16.439 --> 00:08:18.519
and the murder weapon was determined to be the core

138
00:08:18.639 --> 00:08:19.560
to her telephone.

139
00:08:20.160 --> 00:08:24.040
This is you know, somebody's loved one. This is their mom,

140
00:08:24.319 --> 00:08:27.920
their wife, their grandmother. Unbelievable.

141
00:08:28.600 --> 00:08:31.519
Police recovered a hand and fingerprints at the scene, as

142
00:08:31.560 --> 00:08:33.960
well as some black curly hair, and they took her

143
00:08:34.000 --> 00:08:37.360
bed sheets for evidence. Based on the hair found, they

144
00:08:37.399 --> 00:08:40.600
believe that the murderer was a Cuban refugee. And yes,

145
00:08:40.720 --> 00:08:42.919
saying this based on some hair found at the scene

146
00:08:42.919 --> 00:08:47.639
definitely feels racially charged. But unfortunately, I have very little

147
00:08:47.639 --> 00:08:52.240
other information on Narnie's murder. The only thing I can

148
00:08:52.320 --> 00:08:54.960
really say in reference to it was that, according to

149
00:08:55.000 --> 00:08:58.240
an article for the Amarillo Daily News, Narnie was a

150
00:08:58.279 --> 00:09:01.159
member of the Buchanan Street United Methodist Church and she

151
00:09:01.320 --> 00:09:05.080
was active in her community doing volunteer work. But it

152
00:09:05.200 --> 00:09:07.759
seems as if police didn't have a suspect for a

153
00:09:07.799 --> 00:09:11.919
long time. The most notable thing that happened immediately following

154
00:09:11.960 --> 00:09:15.200
her murder, which will be relevant, was the arrest of

155
00:09:15.240 --> 00:09:19.039
a Cuban man caught peeping in the same neighborhood. But

156
00:09:19.399 --> 00:09:23.120
after months of no progress in Narnie Bryson's murder, there

157
00:09:23.240 --> 00:09:27.559
is another body found. On Halloween of nineteen eighty one,

158
00:09:27.720 --> 00:09:30.759
morning mass was conducted at six thirty am at the

159
00:09:30.919 --> 00:09:35.039
Saint Francis Convent at forty three oh one Northeast eighteenth Street,

160
00:09:35.240 --> 00:09:39.559
in the same neighborhood that Narnie lived. The nuns convened

161
00:09:39.559 --> 00:09:42.960
for service, but someone was missing, and that someone was

162
00:09:43.039 --> 00:09:47.159
seventy six year old Sister Tadia. Ben's a very devout

163
00:09:47.240 --> 00:09:53.159
nun who never missed a service of Sister Tada. Bishop Lt. Matheasen,

164
00:09:53.360 --> 00:09:56.600
head of the Amarilla Diocese, said to Donna Weeks from

165
00:09:56.600 --> 00:10:00.159
the Amarilla Daily News quote, she gave a wonderful witness

166
00:10:00.159 --> 00:10:02.320
to her belief in God. Her whole life was a

167
00:10:02.320 --> 00:10:04.679
witness to her belief in God, and she believed in

168
00:10:04.759 --> 00:10:08.320
Him and of a future life. A nun went to

169
00:10:08.399 --> 00:10:10.720
Sister Tedia's room on the second floor of the convent

170
00:10:10.799 --> 00:10:13.879
after Mass at around seven thirty am, where she found

171
00:10:13.919 --> 00:10:18.159
Tadiya deceased. Now, while there was some blood present on

172
00:10:18.240 --> 00:10:20.639
her face, the nuns assumed that she had passed of

173
00:10:20.799 --> 00:10:24.840
natural causes or maybe she had a heart attack, so

174
00:10:25.120 --> 00:10:27.360
they phoned a doctor and they were told to call

175
00:10:27.399 --> 00:10:29.320
a funeral home to have the body picked up and

176
00:10:29.360 --> 00:10:33.559
prepared for burial. Two hours later, police were called when

177
00:10:33.559 --> 00:10:36.000
a broken window was found on the north side of

178
00:10:36.000 --> 00:10:40.480
the convent. Now, when police arrived and began investigating the

179
00:10:40.480 --> 00:10:44.799
break in, they were told about Sister Todya's death. Of course,

180
00:10:44.879 --> 00:10:48.240
police were alarmed and, according to the Ameral Daily News,

181
00:10:48.320 --> 00:10:51.360
called the Potter County Justice of the Peace LB. Bartlett.

182
00:10:52.039 --> 00:10:54.720
He in turn called the funeral parlor and put a

183
00:10:54.799 --> 00:10:58.639
stop to the embalmit. Now, while Sister Todia's body had

184
00:10:58.639 --> 00:11:01.639
been partially cleaned and are material, embombing had already been

185
00:11:01.679 --> 00:11:06.360
completed and autopsy was able to be performed. It was

186
00:11:06.399 --> 00:11:09.919
performed by doctor Ralph Etterman, and in his report he

187
00:11:10.000 --> 00:11:13.240
said that Sister Tadea had been brutally attacked before her death.

188
00:11:13.879 --> 00:11:16.279
She had been beaten and raped with semen and foreign

189
00:11:16.320 --> 00:11:19.679
fluid recovered from her body. She had also been strangled

190
00:11:19.720 --> 00:11:22.919
manually based on the bruising to her neck, and there

191
00:11:23.000 --> 00:11:26.440
was stab wounds present on her body. Her time of

192
00:11:26.559 --> 00:11:29.120
death was determined to be around four thirty on the

193
00:11:29.159 --> 00:11:33.360
morning of October thirty first. Sister Tadia's murder was eerily

194
00:11:33.480 --> 00:11:36.480
similar to Narnie Bryson's and police knew they needed to

195
00:11:36.480 --> 00:11:40.519
find who was responsible. This race to find the killer

196
00:11:40.600 --> 00:11:44.279
was made even more urgent when police learned that another

197
00:11:44.360 --> 00:11:48.279
woman had been attacked only hours after Sister Todya's murder.

198
00:11:49.240 --> 00:11:52.000
A seventy seven year old woman was beaten on conscious

199
00:11:52.200 --> 00:11:54.519
in her home and left for dead before a friend

200
00:11:54.559 --> 00:11:58.240
found her. Now, luckily, this woman survived and came out

201
00:11:58.279 --> 00:12:01.039
of her brief coma, but she was so traumatized she

202
00:12:01.039 --> 00:12:05.279
couldn't give any information to police. Police strongly believe that

203
00:12:05.320 --> 00:12:08.679
these cases were all linked. According to an article for

204
00:12:08.720 --> 00:12:11.840
the Amarilla Daily News, professor Willie Brown from the Criminal

205
00:12:11.960 --> 00:12:15.960
Justice Department at Texas State University agreed with the idea

206
00:12:16.039 --> 00:12:20.080
that the same person had committed these crimes. He said, quote,

207
00:12:20.120 --> 00:12:22.720
there is a good chance that the person attacking older

208
00:12:22.759 --> 00:12:26.240
women in Amarillo has done so before, has been arrested

209
00:12:26.279 --> 00:12:28.519
for it, and has spent time in prison or a

210
00:12:28.559 --> 00:12:32.759
mental hospital for his crime. This person is probably Catholic

211
00:12:32.840 --> 00:12:35.440
or raised Catholic, And there is a good chance the

212
00:12:35.559 --> 00:12:38.279
nun that was killed was not selected as a particular

213
00:12:39.000 --> 00:12:41.120
The decision was made to rape and kill a nun,

214
00:12:41.440 --> 00:12:45.320
not any particular nun, just a nun. I am almost

215
00:12:45.399 --> 00:12:48.559
sure that this person has lots of religious conflicts, and

216
00:12:48.639 --> 00:12:51.679
I have problems believing this person is a longtime resident

217
00:12:51.720 --> 00:12:55.639
of Amarilla. So, based on what this professor is saying,

218
00:12:55.799 --> 00:12:58.039
he does not believe that the person that did this

219
00:12:58.559 --> 00:13:03.279
is a native of Amarillo. He also believes that they

220
00:13:03.360 --> 00:13:07.440
have some issues with religion and they've clearly done this before.

221
00:13:07.960 --> 00:13:09.679
Well. I think if they were able to get in

222
00:13:09.759 --> 00:13:12.840
and out of the convent with nobody hearing them, more

223
00:13:12.879 --> 00:13:16.360
than likely this person has done it before. At the convent,

224
00:13:16.480 --> 00:13:19.639
police gathered whatever evidence they could. In front of the

225
00:13:19.639 --> 00:13:21.759
broken window, they found a piece of wood believed to

226
00:13:21.799 --> 00:13:24.440
have been used to smash the glass, and in sister

227
00:13:24.519 --> 00:13:27.159
Tada's bedroom they managed to get a fingerprint off of

228
00:13:27.159 --> 00:13:30.399
her headboard. The sheets on her bed were collected, Some

229
00:13:30.519 --> 00:13:33.679
black curly hair was found, and police found two knives.

230
00:13:34.039 --> 00:13:37.080
One was a kitchen knife some say it was a

231
00:13:37.080 --> 00:13:40.200
butter knife specifically, which was found under her bed, and

232
00:13:40.240 --> 00:13:42.200
the other was a steak knife that they found in

233
00:13:42.240 --> 00:13:45.600
the driveway of the convent. While police searched the convent

234
00:13:45.639 --> 00:13:48.279
for evidence, they also spoke to anyone in the area

235
00:13:48.360 --> 00:13:50.399
they could in the hopes they could find a witness.

236
00:13:51.519 --> 00:13:54.960
Residents near the convent reported seeing a dark skinned Cuban

237
00:13:55.039 --> 00:13:57.360
man with dark curly hair near the convent on the

238
00:13:57.399 --> 00:14:00.840
morning of the murder, and some witnesses placed the same

239
00:14:00.919 --> 00:14:04.879
man at the convent the night before. Incidentally, there was

240
00:14:04.919 --> 00:14:08.240
a man in custody suspected of assault and attempted rape

241
00:14:08.240 --> 00:14:10.399
of a twenty one year old woman on the day

242
00:14:10.480 --> 00:14:14.960
of Sister Toda's murder who matched the description, and this

243
00:14:15.039 --> 00:14:17.960
man was twenty eight year old Fernando Flores, who was

244
00:14:18.000 --> 00:14:21.240
a Cuban refugee. Okay, so tell me about Fernando.

245
00:14:21.639 --> 00:14:24.679
Well, I don't know a lot about Fernando. These witnesses

246
00:14:24.720 --> 00:14:28.519
were shown photographs of various men, including Fernando, and they

247
00:14:28.639 --> 00:14:31.480
all indicated that he was the man they saw hanging

248
00:14:31.480 --> 00:14:35.519
around the convent. Now on November fifth, according to the

249
00:14:35.519 --> 00:14:40.120
Amarilla Daily News, Sergeant Greg Sultis, an identification technician for

250
00:14:40.200 --> 00:14:43.559
the Major Crime Unit, flew to Washington, DC to deliver

251
00:14:43.720 --> 00:14:47.120
evidence from both Narni's and Sister Todaz murders to the

252
00:14:47.279 --> 00:14:51.519
FBI to have them analyzed. The evidence included the fibers

253
00:14:51.519 --> 00:14:55.440
found on Fernando Flores's clothes, the Harris found at both scenes,

254
00:14:55.799 --> 00:14:59.240
both sets of bedsheets, fingerprints found at both crime scenes

255
00:14:59.279 --> 00:15:03.519
and the butter night. The Potter County Identification Division Lab

256
00:15:03.679 --> 00:15:06.279
also had tests and conducted with the new laser to

257
00:15:06.279 --> 00:15:09.559
try and recover additional fingerprints for the knives, but they

258
00:15:09.600 --> 00:15:12.279
were hesitant to use it on other evidence, as the

259
00:15:12.360 --> 00:15:15.639
laser was used in conjunction with a chemical that they

260
00:15:15.679 --> 00:15:19.519
worried would damage the other evidence. After being analyzed by

261
00:15:19.519 --> 00:15:22.799
the FBI, the fibers and harris present on Fernando's clothing

262
00:15:23.159 --> 00:15:27.000
was found to be inconclusive, so police let Fernando go.

263
00:15:27.720 --> 00:15:29.960
By the end of the first speak of the investigation,

264
00:15:30.360 --> 00:15:35.360
police it seemed had no suspects, but then a clairvoyant

265
00:15:35.440 --> 00:15:40.200
came forward and changed everything. This clairvoyant, who went by

266
00:15:40.200 --> 00:15:42.399
the name Bubbles and I refused to call her that,

267
00:15:43.039 --> 00:15:46.720
claimed to various newspapers that she had a vision and

268
00:15:46.919 --> 00:15:50.759
knew who the killer was. According to a blog post

269
00:15:50.840 --> 00:15:54.000
by the Skeptical Juror, the clairvoyant claimed that the suspect

270
00:15:54.080 --> 00:15:57.120
was a teenager with an olive complexion, a big nose

271
00:15:57.159 --> 00:16:00.879
and ears, was half black and white, worn Afro style

272
00:16:00.919 --> 00:16:04.440
wig during the murder, and was associated with the name Clyde.

273
00:16:05.399 --> 00:16:08.279
She also claimed this person lived on the same street

274
00:16:08.320 --> 00:16:12.559
as the convent in a small white house. Allegedly, this

275
00:16:12.720 --> 00:16:15.759
clairvoyan decided to look for the house herself and came

276
00:16:15.840 --> 00:16:18.360
upon a house across the street from the convent with

277
00:16:18.399 --> 00:16:22.159
a doghouse out front. This dog house had the name

278
00:16:22.279 --> 00:16:25.320
Clyde on it. A couple of days later, a resident

279
00:16:25.360 --> 00:16:28.200
of the home named Johnny Frank Garrett was arrested for

280
00:16:28.279 --> 00:16:32.600
sister Tedia's murder. He was seventeen years old, slender, with

281
00:16:32.759 --> 00:16:35.879
light brown hair, and had a large nose in big ears.

282
00:16:37.200 --> 00:16:40.000
His fingerprints were tested and they matched the prince found

283
00:16:40.039 --> 00:16:42.080
on the butter knife, as well as the handprint on

284
00:16:42.120 --> 00:16:46.720
sister Todiya's headboard. The knife found in the driveway allegedly

285
00:16:46.759 --> 00:16:49.679
matched the brand of knives in Johnny's kitchen, although neither

286
00:16:49.720 --> 00:16:52.559
of the knives were the ones used to stab sister Tadya.

287
00:16:53.360 --> 00:16:56.039
Of the arrest, which was made ten days after Sister

288
00:16:56.080 --> 00:16:59.960
Todia's murder, District Attorney Danny Hill said, quote, the whole

289
00:17:00.159 --> 00:17:03.200
investigation was a concerted effort at the Sheriff's office and

290
00:17:03.240 --> 00:17:06.920
police department. I would describe it as a pure stroke

291
00:17:06.960 --> 00:17:11.079
of good investigation. Had another twelve to fifteen hours gone by,

292
00:17:11.200 --> 00:17:13.200
the body may have been in the ground and nobody

293
00:17:13.240 --> 00:17:17.319
would have ever known there was a murder. Now, Johnny

294
00:17:17.400 --> 00:17:19.799
was obviously questioned about what happened on the night of

295
00:17:19.839 --> 00:17:24.039
sister Toda's murder, However, he was questioned without an attorney

296
00:17:24.119 --> 00:17:28.599
or a parent present. According to the Amarillo Police, Johnny

297
00:17:28.680 --> 00:17:32.359
allegedly confessed to strangling an assaulting sister to Dia after

298
00:17:32.440 --> 00:17:34.920
she woke up in the process of him breaking into

299
00:17:34.960 --> 00:17:37.799
her room to look for things to steal, but when

300
00:17:37.799 --> 00:17:42.799
it came time to sign the confession, Johnny refused. What's

301
00:17:42.880 --> 00:17:45.920
interesting about the confession was that Johnny made no mention

302
00:17:46.079 --> 00:17:50.400
of stabbing sister to doa It's also interesting that while

303
00:17:50.440 --> 00:17:53.720
two fingerprints matched, the pubic hair found at the scene

304
00:17:53.759 --> 00:17:56.759
was confirmed to belong to a Hispanic male with dark hair,

305
00:17:57.279 --> 00:18:00.720
while Johnny was Caucasian with lfe brown hair.

306
00:18:01.119 --> 00:18:03.559
So I'm thinking that they probably have the wrong man

307
00:18:04.119 --> 00:18:07.000
or I mean, I don't understand why they would question

308
00:18:07.079 --> 00:18:10.960
the teenager without some representation.

309
00:18:11.680 --> 00:18:14.200
I agree, and will kind of go into why I

310
00:18:14.279 --> 00:18:17.960
think they did. There's also no mention of police finding

311
00:18:17.960 --> 00:18:21.319
an Afro style wig in his home, contrary to what

312
00:18:21.359 --> 00:18:25.079
the Clairboyan said, and when asked about the black and

313
00:18:25.160 --> 00:18:31.039
white comment, because Johnny was fully Caucasian, she said that

314
00:18:31.079 --> 00:18:35.880
she saw him painting his face half black and half white,

315
00:18:36.160 --> 00:18:39.039
which seems like a weird thing to do.

316
00:18:39.720 --> 00:18:41.359
I agree with you on that one.

317
00:18:41.920 --> 00:18:46.359
But again her statement wasn't rooted. In fact, it was

318
00:18:46.440 --> 00:18:50.039
rooted in this belief in a vision that she had.

319
00:18:50.559 --> 00:18:54.640
Now up Untiljohnny's arrest, as I said, police were convinced

320
00:18:54.759 --> 00:18:58.160
that whoever killed sister Toda had also killed Narnie Bryson,

321
00:18:58.839 --> 00:19:02.799
But Johnny was napper asked about this first murder at all,

322
00:19:03.200 --> 00:19:06.160
which if police have two murders with very similar mos,

323
00:19:06.559 --> 00:19:08.680
I would think that they would have asked Johnny about

324
00:19:08.680 --> 00:19:09.359
this murder too.

325
00:19:10.000 --> 00:19:13.200
I would think so. But again I am not a

326
00:19:13.200 --> 00:19:16.200
police officer, so I don't know how they fully conduct

327
00:19:16.400 --> 00:19:19.279
there I'll say interrogation or interview.

328
00:19:19.680 --> 00:19:22.720
Johnny is charged with murder and is jailed to await trial.

329
00:19:23.920 --> 00:19:28.359
While there, he is interviewed by multiple psychologists, and all

330
00:19:28.400 --> 00:19:31.400
of them determined that Johnny suffered from brain damage, was

331
00:19:31.480 --> 00:19:35.480
mentally impaired, and was chronically psychotic. All is a result

332
00:19:35.519 --> 00:19:39.720
of his childhood. Now, Johnny suffered severe sexual abuse as

333
00:19:39.720 --> 00:19:41.960
a child at the hands of his stepfather and was

334
00:19:42.000 --> 00:19:45.480
trafficked to other men. He was forced to perform sex

335
00:19:45.519 --> 00:19:48.839
ax for pornographic pictures and videos, and was physically abused

336
00:19:48.839 --> 00:19:52.279
as well. He was introduced to alcohol and drugs at

337
00:19:52.319 --> 00:19:54.480
the age of ten, and was also taught to use

338
00:19:54.480 --> 00:19:58.720
paint thinner and amphetamines to get high. So this destroyed

339
00:19:59.160 --> 00:20:03.279
his brain. The abuse, the drug addiction, all of it,

340
00:20:03.400 --> 00:20:06.680
all of it. This man was horrifically abused for most,

341
00:20:06.720 --> 00:20:09.240
if not all, of his childhood and it caused severe

342
00:20:09.279 --> 00:20:12.799
mental damage and led to paranoid delusions. That right then

343
00:20:12.839 --> 00:20:17.240
and there is indicative to me that he's most likely

344
00:20:17.440 --> 00:20:19.880
considered criminally insane.

345
00:20:20.240 --> 00:20:21.839
And what are the crimes do you commit?

346
00:20:22.640 --> 00:20:27.559
Just the murder supposedly supposedly, yeah, just the murder, So

347
00:20:28.240 --> 00:20:31.279
then I don't think it would be criminally insane. Well,

348
00:20:31.559 --> 00:20:33.359
in terms of the trial, that would lead me to

349
00:20:33.400 --> 00:20:35.880
believe that he is not. He doesn't have the mental

350
00:20:35.960 --> 00:20:37.359
faculties to stand trial.

351
00:20:37.920 --> 00:20:39.079
I agree with you. Yes.

352
00:20:39.440 --> 00:20:41.880
Prior to his trial, he wrote and received a lot

353
00:20:41.920 --> 00:20:44.400
of letters, one of the letters being from his lawyer

354
00:20:44.559 --> 00:20:48.079
VG Colius telling him not to testify on his own behalf,

355
00:20:48.599 --> 00:20:52.359
and I'll read a portion of it for you. It said, quote,

356
00:20:52.440 --> 00:20:54.839
as we explain to you, if you take the stand

357
00:20:54.880 --> 00:20:58.279
to testify, you might be impeached. That is the state.

358
00:20:58.319 --> 00:21:00.599
We'll try to make a liar out of you by

359
00:21:00.720 --> 00:21:03.599
anything that you have said before trial that is different

360
00:21:03.599 --> 00:21:05.720
from what you say at the time of the trial.

361
00:21:06.559 --> 00:21:09.960
Several police officers are going to testify that you told

362
00:21:09.960 --> 00:21:12.960
them about entering the convent, going into the nuns room,

363
00:21:13.079 --> 00:21:15.920
and choking her and having sex with her. They are

364
00:21:15.960 --> 00:21:19.200
going to testify that after you told them all about

365
00:21:19.240 --> 00:21:21.480
the crime, that they typed up a statement of what

366
00:21:21.519 --> 00:21:23.720
you had said to them, but that you refuse to

367
00:21:23.839 --> 00:21:27.640
sign it. As we have explained to you, this statement

368
00:21:27.759 --> 00:21:30.440
is not admissible unless you want to get on the

369
00:21:30.480 --> 00:21:34.640
witness stand and testify on your own behalf. Also, when

370
00:21:34.720 --> 00:21:37.559
your prior statement gets into evidence, there is a strong

371
00:21:37.720 --> 00:21:40.759
likelihood that we will not be entitled to our circumstantial

372
00:21:40.759 --> 00:21:45.240
evidence charge. As you know, this charge is very favorable

373
00:21:45.480 --> 00:21:47.519
to you, and losing it is the loss of a

374
00:21:47.559 --> 00:21:50.960
big item in our defense. The reason I am writing

375
00:21:51.000 --> 00:21:53.559
you this letter is to make sure that you understand

376
00:21:53.599 --> 00:21:56.720
the risk you are taking it take the stand to testify.

377
00:21:57.920 --> 00:22:00.160
We want you to realize and understand that you you

378
00:22:00.200 --> 00:22:03.240
do not have to testify, and whether you testify or

379
00:22:03.319 --> 00:22:06.319
not is a decision that you and you alone must make.

380
00:22:06.880 --> 00:22:09.640
This is not a decision that we can make for you.

381
00:22:11.400 --> 00:22:13.759
Now His lawyer goes on to say that he understands

382
00:22:13.759 --> 00:22:15.960
that Johnny wants to get his side of the story

383
00:22:16.000 --> 00:22:17.839
out there, but he will not be able to protect

384
00:22:17.880 --> 00:22:22.079
Johnny during cross examination. He also told Johnny that if

385
00:22:22.079 --> 00:22:25.160
there was anything he didn't understand in the letter, to

386
00:22:25.480 --> 00:22:28.440
not sign it, because if he signed it, Coldius said

387
00:22:28.480 --> 00:22:30.799
he would take that as Johnny's saying that he would

388
00:22:30.799 --> 00:22:34.880
be taking the stand since Johnny would go on to

389
00:22:34.920 --> 00:22:37.559
testify at his trial. I can only assume he signed

390
00:22:37.599 --> 00:22:38.279
the letter.

391
00:22:39.000 --> 00:22:42.279
But my question is what did he understand the entire letter?

392
00:22:43.119 --> 00:22:45.519
That's what I want to know. I don't know if

393
00:22:45.519 --> 00:22:49.359
he fully understood that letter. And it's very clear that

394
00:22:49.440 --> 00:22:52.240
the lawyer is trying to help him, like, look, if

395
00:22:52.240 --> 00:22:56.119
you don't understand anything in this letter, don't sign it.

396
00:22:56.960 --> 00:22:59.799
But why didn't he have that conversation in person.

397
00:23:00.440 --> 00:23:02.680
It seems that they did have a conversation in person.

398
00:23:03.400 --> 00:23:05.759
What I'm assuming is a lawyer needed something in writing

399
00:23:05.799 --> 00:23:09.960
that Johnny was going to testify for legality's sake, so

400
00:23:10.039 --> 00:23:13.319
he wrote them this letter after the conversation, laying out

401
00:23:13.319 --> 00:23:17.279
the conversation saying, Okay, now if you sign this, you're

402
00:23:17.440 --> 00:23:20.519
saying that you're going to testify, but if you don't

403
00:23:20.680 --> 00:23:23.759
understand what I'm saying to you in Layman's terms in

404
00:23:23.799 --> 00:23:26.640
this letter, do not sign it. You will not testify.

405
00:23:27.200 --> 00:23:29.440
And I think what it was was that Johnny wanted

406
00:23:29.519 --> 00:23:33.200
to testify really bad like he wanted to because he

407
00:23:33.240 --> 00:23:36.640
wrote in a letter, in multiple letters, that he didn't

408
00:23:36.640 --> 00:23:38.920
get his he didn't get a chance to say his

409
00:23:39.039 --> 00:23:39.920
side of the story.

410
00:23:40.359 --> 00:23:43.160
Okay, I understand where he's coming from.

411
00:23:43.400 --> 00:23:46.519
The trials started in nineteen eighty two, and it went

412
00:23:47.039 --> 00:23:50.559
very badly for Johnny. He was allegedly seen running from

413
00:23:50.559 --> 00:23:53.200
the convent on the night of the murder, which is

414
00:23:53.279 --> 00:23:56.160
interesting because when the police canvassed the area, I can

415
00:23:56.200 --> 00:23:59.960
find nothing stating that they had found anyone that plays

416
00:24:00.160 --> 00:24:04.039
Tim or anyone matching his description at the convent. They

417
00:24:04.039 --> 00:24:06.039
had the prints on the knives, and they said that

418
00:24:06.039 --> 00:24:10.319
the pubic hair matched characteristics of Johnny's, which again is

419
00:24:10.319 --> 00:24:14.480
interesting because they had no actual DNA evidence to support that,

420
00:24:15.079 --> 00:24:18.880
and this was in nineteen eighty nineteen eighty two. I

421
00:24:18.880 --> 00:24:24.400
don't believe that DNA evidence was that advanced at that time. True,

422
00:24:24.640 --> 00:24:29.680
But we're going to go into what happened with the DNA. Okay, Now,

423
00:24:29.720 --> 00:24:33.000
as I mentioned, doctor Erdman recovered fluid and semen from

424
00:24:33.000 --> 00:24:37.599
the autopsy, but he didn't have it tested. According to

425
00:24:37.680 --> 00:24:41.359
court records, the evidence was discarded by Erdmin because he

426
00:24:41.440 --> 00:24:43.920
didn't have the equipment necessary to analyze it.

427
00:24:44.519 --> 00:24:46.559
Why would you discard it? Wouldn't you send it to

428
00:24:46.599 --> 00:24:52.039
a facility that had the equipment necessary to test well?

429
00:24:52.039 --> 00:24:54.279
According to doctor Erdman, and we're going to talk all

430
00:24:54.359 --> 00:24:58.680
about doctor Erdman, he allegedly said that he got rid

431
00:24:58.720 --> 00:25:01.160
of the evidence because he was never told to keep it.

432
00:25:01.720 --> 00:25:07.400
Aren't you supposed to keep evidence throughout the trial because

433
00:25:08.880 --> 00:25:15.480
if the defense or the prosecution needs it for whatever reason.

434
00:25:16.279 --> 00:25:19.240
Yes, no, exactly, you're right. He threw it out. Well,

435
00:25:19.319 --> 00:25:20.839
no one told me to keep it. He threw it out.

436
00:25:21.359 --> 00:25:24.960
We're going to talk all about doctor Edmund, all about him.

437
00:25:25.359 --> 00:25:28.559
So they don't have that d in evidence, but there

438
00:25:28.559 --> 00:25:33.559
are similar characteristics. An inmate of the Potter County Jail

439
00:25:33.680 --> 00:25:37.799
names Lonnie Watley, also testified that Johnny had allegedly denied

440
00:25:37.839 --> 00:25:41.599
committing the murders to him before ultimately confessing. And I'm

441
00:25:41.759 --> 00:25:45.079
very curious as to what Lonnie got out of testifying

442
00:25:45.480 --> 00:25:47.240
because he was an inmate, So like, what did you

443
00:25:47.279 --> 00:25:50.480
get in exchange for a testimony. I'm not saying he's lying.

444
00:25:50.759 --> 00:25:53.759
I'm just saying, like, what's a valid question. You know,

445
00:25:54.640 --> 00:25:59.839
a lot of times inmate testimony is very much a

446
00:26:00.079 --> 00:26:03.160
eye scratcher, back, he scratch mine kind of thing. So

447
00:26:03.359 --> 00:26:06.640
I'm just saying, when Johnny gets on the stand to testify,

448
00:26:07.079 --> 00:26:11.599
he proclaims his innocence. According to court records, Johnny said

449
00:26:11.599 --> 00:26:14.759
that he had broken into the convent but two days

450
00:26:14.960 --> 00:26:18.359
prior to the murder, looking for things to steal, coming

451
00:26:18.400 --> 00:26:21.640
in through the front door. He said he went into

452
00:26:21.640 --> 00:26:24.680
the medication room and the cafeteria, and he went into

453
00:26:24.759 --> 00:26:27.640
several bedrooms, prying open a locked door with a knife

454
00:26:27.680 --> 00:26:30.920
he got from the kitchen. He also said that he

455
00:26:31.000 --> 00:26:33.319
had gone into sister to do his room and had

456
00:26:33.319 --> 00:26:36.440
braced himself against the headboard, reaching up for a cross

457
00:26:36.480 --> 00:26:39.680
on the wall. He said he was startled by a

458
00:26:39.720 --> 00:26:42.240
noise and fled, going to his mother's house on the

459
00:26:42.279 --> 00:26:46.200
evening off October thirtieth and staying there until the next morning.

460
00:26:46.319 --> 00:26:49.160
And he claimed that he leapt the exact same way

461
00:26:49.200 --> 00:26:51.599
he came in the front door. He never went to

462
00:26:51.640 --> 00:26:55.799
a window. Now During the cross examination, Johnny was presented

463
00:26:55.839 --> 00:26:58.519
with the unsigned statement he made to police, where he

464
00:26:58.559 --> 00:27:01.400
allegedly said he broke his the convent via the broken

465
00:27:01.440 --> 00:27:05.519
window and heading into sister to do this room. According

466
00:27:05.559 --> 00:27:08.400
to court records, his statement said quote, there was a

467
00:27:08.480 --> 00:27:10.319
nun in bed and she acted as if she was

468
00:27:10.359 --> 00:27:12.880
going to scream. I covered her mouth so she wouldn't

469
00:27:12.920 --> 00:27:16.400
make any noise. I started choking her until she passed out.

470
00:27:16.599 --> 00:27:18.680
I had sex with her. I left the convent the

471
00:27:18.720 --> 00:27:23.480
way I came in. Now, according to Johnny, he denied

472
00:27:23.519 --> 00:27:27.039
this statement ever happened. Quote the police officer would say

473
00:27:27.079 --> 00:27:29.640
something and I would say put it down. He would

474
00:27:29.640 --> 00:27:32.000
say something else and I would say, go ahead, put

475
00:27:32.039 --> 00:27:35.599
it down. Then he said sign this, and I said

476
00:27:35.680 --> 00:27:40.160
I ain't signing nothing. So, first of all, it seems

477
00:27:41.119 --> 00:27:43.759
to me, at least that the interview wasn't recorded at

478
00:27:43.759 --> 00:27:46.880
the time the statement was allegedly made, which is made

479
00:27:47.039 --> 00:27:50.480
evident by the fact that they didn't play a recording

480
00:27:50.599 --> 00:27:54.400
or anything like that in or during the trial. It

481
00:27:54.559 --> 00:27:58.000
seems also that, at least according to Johnny, the police

482
00:27:58.000 --> 00:28:01.759
officer who interviewed him was possible leading him in the

483
00:28:01.880 --> 00:28:06.880
interview just based on what Johnny was saying, like, you know,

484
00:28:06.960 --> 00:28:10.039
the police officer would say this, and Johnny would say, okay,

485
00:28:10.119 --> 00:28:11.920
like are you going to write that down? And the

486
00:28:11.960 --> 00:28:14.279
police officer wasn't like, kind of I guess, kind of

487
00:28:14.359 --> 00:28:18.720
leading him into saying that he killed Sister Tada. Just

488
00:28:18.799 --> 00:28:21.839
based on the court records and how his testimony went,

489
00:28:21.960 --> 00:28:24.680
that sounds very much like what he's kind of implying

490
00:28:24.799 --> 00:28:28.400
happened based on the well, you know, I said write

491
00:28:28.400 --> 00:28:30.079
it down, like are you going to put that down?

492
00:28:30.640 --> 00:28:33.359
And the officer just ignoring that, and then it was okay,

493
00:28:33.400 --> 00:28:36.599
sign the statement, and Johnny's going, I'm not signing it now.

494
00:28:36.680 --> 00:28:39.920
Also brought to his testify with Sister Bernice Knogler, who

495
00:28:39.960 --> 00:28:43.440
claimed that the convent doors were typically kept locked and

496
00:28:43.680 --> 00:28:46.119
that Johnny would not have been able to make it inside,

497
00:28:46.240 --> 00:28:48.720
let alone all the way to the cafeteria by lunchtime

498
00:28:48.759 --> 00:28:52.480
without anyone seeing him. She also claimed that no drawers

499
00:28:52.519 --> 00:28:54.480
or chests were kept locked in any of the rooms,

500
00:28:54.519 --> 00:28:56.960
and that Sister Tada didn't have a cross hanging over

501
00:28:57.000 --> 00:28:59.920
her bed. I am not saying this. None is lying.

502
00:29:00.920 --> 00:29:03.400
In fact, it's pretty much a given that nuns usually

503
00:29:03.440 --> 00:29:07.480
do not lie. I'm also saying, though, that I don't

504
00:29:07.480 --> 00:29:09.920
think it is physically impossible for Johnny have made it

505
00:29:09.920 --> 00:29:13.279
into the convent without being seen. It's not impossible.

506
00:29:14.119 --> 00:29:15.680
No, there's always possibilities.

507
00:29:16.039 --> 00:29:20.559
It's also I also don't think that you could say,

508
00:29:20.559 --> 00:29:23.400
without a shadow of a doubt unless they personally checked

509
00:29:23.440 --> 00:29:25.680
every day the chest and drawers in every room with

510
00:29:25.759 --> 00:29:28.559
the convent, that none of them are locked, unless they

511
00:29:28.559 --> 00:29:30.759
didn't have a way to be locked, which I don't know.

512
00:29:31.960 --> 00:29:32.279
Okay.

513
00:29:33.079 --> 00:29:35.680
I also think it's unusual to say that Sister Toia

514
00:29:35.720 --> 00:29:37.799
didn't have a cross in her room. Now I don't

515
00:29:37.839 --> 00:29:40.240
know she meant that she didn't specifically have a cross

516
00:29:40.279 --> 00:29:43.599
hanging over her bed, which again a little unusual, because

517
00:29:43.960 --> 00:29:49.119
most very religious people do have a cross hanging over

518
00:29:49.119 --> 00:29:52.960
their bed or in their room itsel or, but at

519
00:29:53.000 --> 00:29:55.440
the very least that's usually in their room. So again

520
00:29:55.519 --> 00:29:57.200
I'm not saying she's lying. I don't know the layout

521
00:29:57.240 --> 00:29:59.599
of the room. There's no pictures of what the room

522
00:29:59.640 --> 00:30:02.440
looked like like, I have no idea. But at least

523
00:30:02.480 --> 00:30:07.319
according to her, what Johnny's saying is not true. It's

524
00:30:07.400 --> 00:30:12.000
not possible. I'm saying that there's room for doubt.

525
00:30:12.279 --> 00:30:16.720
Well, there's always room for doubt, because even if she

526
00:30:16.920 --> 00:30:22.240
didn't have a across her crucifix hanging over her bed,

527
00:30:22.799 --> 00:30:26.160
it didn't mean that, you know, because old nuns have

528
00:30:26.319 --> 00:30:29.799
rosaries that she didn't have that. You know, maybe there

529
00:30:29.839 --> 00:30:31.400
was a nail on the wall over her bed and

530
00:30:31.400 --> 00:30:34.920
she would hang that before she went to bed, or

531
00:30:35.000 --> 00:30:38.240
she had it on her like her bed post.

532
00:30:38.640 --> 00:30:42.440
Exactly. Yeah. And you know, Johnny says that he left

533
00:30:42.519 --> 00:30:46.079
in Sister Bernice said that nothing was stolen, but that

534
00:30:46.079 --> 00:30:49.039
doesn't mean he wasn't trying to steal something, you know,

535
00:30:49.119 --> 00:30:51.319
it doesn't mean that he went in there with the

536
00:30:51.400 --> 00:30:55.720
intention of killing somebody. He could have very easily have

537
00:30:55.759 --> 00:30:57.799
gone in there trying to steal something. But you know,

538
00:30:57.880 --> 00:31:00.680
he's seventeen years old. Seventeen year old are kind of anyway.

539
00:31:01.119 --> 00:31:03.359
They think, ooh, it's a convent, like, you know, there's

540
00:31:03.359 --> 00:31:05.920
probably something good to steal in there. And you know,

541
00:31:06.039 --> 00:31:09.359
a lot of people, I think don't realize that most

542
00:31:09.440 --> 00:31:14.599
nuns live a very like pious simple life. They don't

543
00:31:14.640 --> 00:31:19.960
have anything extra extravagant. They're going to have the basic necessities.

544
00:31:19.960 --> 00:31:21.839
They're going to have their clothing, they're going to have

545
00:31:21.880 --> 00:31:25.359
their bible, maybe a couple of books. It's very simple jewelry.

546
00:31:25.400 --> 00:31:29.039
A lot of them were wooden jewelry. It's very possible

547
00:31:29.039 --> 00:31:30.599
he went in there looking to steal something and there's

548
00:31:30.640 --> 00:31:34.839
nothing really worth stealing, or anything worth stealing was locked

549
00:31:34.839 --> 00:31:35.680
away somewhere.

550
00:31:36.640 --> 00:31:40.119
Well, I'm sure like if you know, maybe a chalice

551
00:31:40.319 --> 00:31:45.279
or you know that are used that's used for certain occasions,

552
00:31:45.599 --> 00:31:48.119
or it could be a tray, a silver tray.

553
00:31:48.160 --> 00:31:52.200
Yeah, or like you know, a like a candle holders

554
00:31:52.279 --> 00:31:54.279
you know, maybe you know. So I'm sure there were

555
00:31:54.359 --> 00:31:58.079
probably some things too, steel, but probably not where he

556
00:31:58.240 --> 00:32:00.759
was looking, because he was looking in bedrooms, in drawers

557
00:32:00.799 --> 00:32:03.079
and things like that where people are going to keep

558
00:32:03.119 --> 00:32:08.400
their clothing, their bibles, their you know, simple jewelry. So

559
00:32:08.480 --> 00:32:12.039
again not saying she's lying at all, I'm sure she's

560
00:32:12.160 --> 00:32:14.920
The likelihood of her lying is slim to non. I

561
00:32:14.960 --> 00:32:18.519
doubt she's lying, But I don't think that her saying

562
00:32:18.519 --> 00:32:21.440
that it's completely impossible is realistic.

563
00:32:22.200 --> 00:32:25.039
Now, because there's always a way, you know, where they

564
00:32:25.480 --> 00:32:27.400
that's saying goes, you know, where there's a will, there's

565
00:32:27.440 --> 00:32:30.599
a way. So could he have done this? Could he

566
00:32:30.640 --> 00:32:32.799
have broken in? Could he have been looking for things

567
00:32:32.839 --> 00:32:38.119
and nobody saw him. Yes, could you know be the

568
00:32:38.240 --> 00:32:42.200
absolute opposite where he walked in. But again, if he

569
00:32:42.240 --> 00:32:44.680
walked in, he probably would not have made it to

570
00:32:44.880 --> 00:32:50.039
her bedroom if somebody had seen him prior to that exactly.

571
00:32:50.079 --> 00:32:53.519
And he's there's physical evidence proving he made it to

572
00:32:53.559 --> 00:32:56.599
her bedroom at the very least. So Johnny was ultimately

573
00:32:56.599 --> 00:33:00.400
found guilty of murder, and during the sentencing hearing, characternesses

574
00:33:00.400 --> 00:33:02.960
were brought up to speak, such as Johnny's mother who

575
00:33:02.960 --> 00:33:04.960
made a plea on his behalf and spoke of his

576
00:33:05.000 --> 00:33:08.759
good relationship with his siblings. Neighbors were called and spoke

577
00:33:08.799 --> 00:33:11.160
of his bad reputation in the neighborhood and how he

578
00:33:11.200 --> 00:33:14.599
had been aggressive in the past, although what specifically they

579
00:33:14.759 --> 00:33:18.279
mean by that, they don't know. That wasn't specified in

580
00:33:18.319 --> 00:33:21.440
the court records that I read. As far as I know,

581
00:33:21.559 --> 00:33:24.480
he had never been in trouble with the law. Maybe

582
00:33:24.480 --> 00:33:27.880
he was just a nuisance to his neighbors kind of thing.

583
00:33:29.279 --> 00:33:32.000
And officers were also called up who worked at the

584
00:33:32.000 --> 00:33:34.759
Potter County Jail who said that Johnny was very well

585
00:33:34.799 --> 00:33:37.839
behaved and hadn't caused any trouble during his time in

586
00:33:37.880 --> 00:33:42.519
custody during the course of the trial. In addition, not

587
00:33:42.799 --> 00:33:46.640
once during any part of the trial did any other

588
00:33:46.759 --> 00:33:49.839
psychiatrists or experts that deemed him to be both mentally

589
00:33:49.880 --> 00:33:55.440
impaired and chronically psychotic ever testify, Nor did anyone bring

590
00:33:55.519 --> 00:33:57.839
up the abuse that attributed to his instability.

591
00:33:59.079 --> 00:34:05.119
Why wouldn't his defence attorney bring up the doctors that

592
00:34:05.200 --> 00:34:09.199
had seen him? It seems like that would be the

593
00:34:09.199 --> 00:34:12.679
first thing. If he's getting all of these doctors' reports

594
00:34:12.679 --> 00:34:16.760
saying that this very young man is suffering from this, that,

595
00:34:16.840 --> 00:34:19.719
and the other thing, why wouldn't you bring that up

596
00:34:19.760 --> 00:34:20.280
in trial?

597
00:34:20.679 --> 00:34:23.760
Well, according to Johnny, in a letter that he had

598
00:34:23.840 --> 00:34:28.480
written to the news, he had written like a letter

599
00:34:28.480 --> 00:34:33.239
to the editor to various newspapers and different media outlets,

600
00:34:33.360 --> 00:34:35.519
basically saying that I did not want this man to

601
00:34:35.519 --> 00:34:38.559
be my lawyer. There were two men that I wanted

602
00:34:38.559 --> 00:34:40.400
to be my lawyer. One was a good friend of

603
00:34:40.400 --> 00:34:42.079
my mom's. One was a good friend of the family.

604
00:34:42.119 --> 00:34:44.800
And the police officers told me no, I had to

605
00:34:44.880 --> 00:34:48.360
have Vegi Colius. Eugi Colius works for them, he doesn't

606
00:34:48.360 --> 00:34:48.840
work for me.

607
00:34:49.559 --> 00:34:52.400
I would think that would cause some sort of a

608
00:34:52.440 --> 00:34:56.360
mistrial to begin with if the attorney, if he feels

609
00:34:56.400 --> 00:34:59.679
the attorney is not working for him but working for

610
00:34:59.719 --> 00:35:00.559
the secution.

611
00:35:01.639 --> 00:35:04.599
I fully agree. But then you also had that letter

612
00:35:04.599 --> 00:35:07.559
that BG Collius wrote. You know, there it seemed like

613
00:35:07.599 --> 00:35:10.360
he was very much, you know, looking out for Johnny's

614
00:35:10.400 --> 00:35:13.360
best interest at the same time, based on the fact

615
00:35:13.360 --> 00:35:18.239
that this very clear indicator of his mental instability and

616
00:35:18.280 --> 00:35:20.760
the trauma he went through being a contributing factor not

617
00:35:20.920 --> 00:35:24.320
being admitted as evidence, the jury never heard about it.

618
00:35:24.960 --> 00:35:27.159
That doesn't look like he's got his best interest.

619
00:35:26.880 --> 00:35:29.440
At heart from that, I would say.

620
00:35:29.519 --> 00:35:33.719
Now, Now, Johnny, according to court records, was sentenced to

621
00:35:33.800 --> 00:35:37.639
death and an appeal for a habeas release was immediately filed.

622
00:35:38.320 --> 00:35:42.440
He was represented by a different attorney after his case concluded.

623
00:35:42.800 --> 00:35:46.039
Now a stay of execution was granted pending an evidentiary

624
00:35:46.159 --> 00:35:49.239
hearing where the sentence for death was reinstated and ordered

625
00:35:49.239 --> 00:35:53.519
to be conducted on October thirtieth, nineteen eighty seven. Then

626
00:35:53.679 --> 00:35:57.599
another stay was ordered pending appeal. Johnny appealed to his

627
00:35:57.760 --> 00:36:02.039
conviction numerous times, all for the same reason quote. By

628
00:36:02.079 --> 00:36:06.079
destroying potentially exculpatory evidence to state denied him a fair

629
00:36:06.159 --> 00:36:10.199
trial and deprived him of due process of law. Now,

630
00:36:10.239 --> 00:36:13.320
this appeal was in reference to the DNA evidence recovered

631
00:36:13.360 --> 00:36:19.199
during sister Tada's autopsy that doctor Erdmund himself said he discarded. However,

632
00:36:19.360 --> 00:36:23.199
according to court records, quote, after doctor Erdman found external

633
00:36:23.199 --> 00:36:26.480
evidence of a rape, he injected saline solution into the

634
00:36:26.519 --> 00:36:30.000
vaginal vaults and recovered a small quantity of fluid. From

635
00:36:30.000 --> 00:36:33.079
these vaginal washings, doctor Erdmann tested for the presence of

636
00:36:33.119 --> 00:36:37.000
sperm and prostrate secretions and found both. In addition to

637
00:36:37.079 --> 00:36:40.360
these tests, doctor Erdman used the entire vaginal content sample

638
00:36:40.440 --> 00:36:44.039
he recovered from sister Bends's body. So they're saying in

639
00:36:44.079 --> 00:36:47.320
the court records he used that the entire sample, But

640
00:36:47.440 --> 00:36:52.719
according to the same exact document, literally the same one quote,

641
00:36:52.760 --> 00:36:55.920
no test was conducted from the vaginal contents designed to

642
00:36:55.920 --> 00:36:59.440
determine the assailant's blood type. So either he had enough

643
00:37:00.119 --> 00:37:05.320
to conduct a test that he just didn't perform, or

644
00:37:05.360 --> 00:37:06.400
he used up everything.

645
00:37:06.760 --> 00:37:08.159
But either way he got rid of it.

646
00:37:08.280 --> 00:37:09.599
Either way he got rid of it.

647
00:37:09.639 --> 00:37:11.840
So he had But if he got rid of it,

648
00:37:12.960 --> 00:37:18.360
then that, at least to me, implies that he had

649
00:37:18.519 --> 00:37:22.119
enough to do all of the testing that he needed

650
00:37:22.159 --> 00:37:22.360
to do.

651
00:37:22.599 --> 00:37:25.679
That's what I'm saying. And again we're gonna talk about

652
00:37:25.679 --> 00:37:29.400
doctor Erdman. I'm not done with him. Not done, Okay,

653
00:37:29.440 --> 00:37:30.800
so we're all going to wait for the other shoe

654
00:37:30.840 --> 00:37:34.679
to drop because we I know she's got way more

655
00:37:34.719 --> 00:37:37.920
things to say about this he do. So there's also

656
00:37:37.920 --> 00:37:39.960
the issue that much of the evidence gathered at the

657
00:37:40.000 --> 00:37:43.199
scene was not used in court, so the jury never

658
00:37:43.239 --> 00:37:46.239
heard about it. This included footprints that did not belong

659
00:37:46.320 --> 00:37:49.199
to Johnny, a bloody shirt found in her room that

660
00:37:49.239 --> 00:37:52.400
didn't belong to him, a saw that didn't belong to him,

661
00:37:52.480 --> 00:37:54.760
as well as the fingerprints found at the scene that

662
00:37:54.800 --> 00:37:57.800
we're from an unknown person, as well as black hairs

663
00:37:58.039 --> 00:38:01.880
because Johnny's fingerprints only for a matched two fingerprints, one

664
00:38:01.920 --> 00:38:03.920
on the butter knife, one on the headboard. That's it.

665
00:38:04.360 --> 00:38:07.000
I'm really trying to wrap my head around this, that

666
00:38:07.360 --> 00:38:10.760
this young man did not get a fair trial in

667
00:38:10.800 --> 00:38:14.960
any way, shape or form. You have all of this evidence. Now,

668
00:38:15.639 --> 00:38:20.679
you can't hide evidence, no from a defense attorney.

669
00:38:20.800 --> 00:38:22.159
You also can't hide it from the jury.

670
00:38:22.599 --> 00:38:26.519
Well that's true, but you you can't hide it initially

671
00:38:26.559 --> 00:38:30.960
from the defense attorney. Okay, there's like this whole transparency thing,

672
00:38:32.039 --> 00:38:36.760
and I says, the evidence we're going to use, Okay, Lea,

673
00:38:36.920 --> 00:38:40.719
let's send it over to the defense attorney because they

674
00:38:41.239 --> 00:38:44.079
can't be surprised. It's not it's not allowed.

675
00:38:44.480 --> 00:38:49.719
No, exactly, it's not allowed at all. But also, and

676
00:38:49.760 --> 00:38:51.840
I'm not saying if he's guilty, he's guilty, but he

677
00:38:51.880 --> 00:38:54.239
needs a fair trial, and this is not fair.

678
00:38:54.320 --> 00:38:58.039
If they only found two of his fingerprints, and every

679
00:38:58.079 --> 00:39:03.239
other piece of evidence shirt, the bloody shirt, the hair,

680
00:39:03.360 --> 00:39:08.719
or the everything doesn't match him, why would you even

681
00:39:09.320 --> 00:39:12.960
why would they even proceed with a trial if there

682
00:39:13.039 --> 00:39:14.559
is evidence that does not.

683
00:39:14.559 --> 00:39:19.119
Match exactly now. Additionally, according to the blog post from

684
00:39:19.159 --> 00:39:22.639
the Skeptical jerm And, I'm hesitant to his blog posts

685
00:39:22.639 --> 00:39:25.320
and things like this, but you very well thought out,

686
00:39:25.360 --> 00:39:27.880
and what they're saying matches what I read in court

687
00:39:27.920 --> 00:39:31.199
documents and all of that. Based on this blog post,

688
00:39:31.440 --> 00:39:33.679
a fourteen year old boy had been interviewed and he

689
00:39:33.760 --> 00:39:36.320
claimed that he had been with Johnny when Johnny said

690
00:39:36.320 --> 00:39:39.000
he broke into the cont two days prior to the murder.

691
00:39:39.039 --> 00:39:42.679
But of course that an interview was conducted outside of court.

692
00:39:43.039 --> 00:39:45.280
The jury never heard about it. No one ever heard

693
00:39:45.280 --> 00:39:47.639
about it. Then, of course you have the issue that

694
00:39:47.679 --> 00:39:51.440
the police absolutely believed that the same person who killed

695
00:39:51.519 --> 00:39:55.079
sister Tadia killed by Narnie Bryson, But when Johnny was arrested,

696
00:39:55.199 --> 00:39:58.719
they never once asked him about Narnie's murder, which doesn't

697
00:39:58.760 --> 00:40:00.719
make sense to me. You were so convinced that the

698
00:40:00.719 --> 00:40:04.599
same person committed both attacks, but you only ask the

699
00:40:04.599 --> 00:40:08.760
person that you were insisting killed one. You're not asking

700
00:40:08.800 --> 00:40:10.039
about the other's.

701
00:40:10.400 --> 00:40:14.960
It sounds like there's some serious Shannigan's going on here,

702
00:40:15.440 --> 00:40:18.920
And why isn't It seems like to me, why isn't

703
00:40:18.920 --> 00:40:24.840
anybody in this young man's corner fighting for him? You know,

704
00:40:24.880 --> 00:40:27.719
his attorney's supposed to do that. They have all this

705
00:40:27.800 --> 00:40:32.360
other evidence that I would say lends to some serious

706
00:40:32.480 --> 00:40:36.719
doubt on whether he murdered this nun, And you're not saying, well,

707
00:40:36.719 --> 00:40:39.039
why isn't you know we're gonna if you're not gonna

708
00:40:39.039 --> 00:40:41.559
bring this evidence up, I'm gonna bring this evidence up.

709
00:40:42.000 --> 00:40:44.519
I mean, you can't put two and two together and

710
00:40:44.559 --> 00:40:48.280
get five. So why isn't anybody in this young man's

711
00:40:48.320 --> 00:40:52.159
corner going, hey, you have a bloody shirt doesn't match his?

712
00:40:53.039 --> 00:40:54.920
Did you test the blood on the shirt. Is it

713
00:40:54.960 --> 00:40:58.400
a match to his blood type? You have hairs that

714
00:40:58.519 --> 00:41:02.280
you found that don't belong to the sister and don't

715
00:41:02.320 --> 00:41:06.239
belong to him. Where did they come from? Why isn't

716
00:41:06.239 --> 00:41:10.440
anybody questioning all of this other evidence? Why isn't anybody

717
00:41:10.599 --> 00:41:15.880
testing any of this other evidence? Yes he had there

718
00:41:15.880 --> 00:41:20.519
were two fingerprints that belonged to him. Did they find

719
00:41:20.559 --> 00:41:23.159
any other fingerprints that didn't belong to him?

720
00:41:23.400 --> 00:41:24.360
Yes? They did.

721
00:41:26.000 --> 00:41:28.239
Why isn't anybody saying that this is what I'm saying.

722
00:41:29.400 --> 00:41:32.320
You find all of these all of this other evidence,

723
00:41:32.320 --> 00:41:35.280
but nobody's bothering to say, hey, wait a minute, what's

724
00:41:35.360 --> 00:41:38.320
going on here? And now you have a young man

725
00:41:38.440 --> 00:41:42.039
that is on death row for a crime he may

726
00:41:42.239 --> 00:41:46.440
or may not have committed, but it lends some serious

727
00:41:46.519 --> 00:41:49.920
doubt to the validity of their case.

728
00:41:50.800 --> 00:41:55.199
So Johnny's appeal was denied once again, and he's awaiting execution.

729
00:41:55.440 --> 00:41:58.280
He's still writing his letters, and during the year spent

730
00:41:58.360 --> 00:42:01.800
on death row, many people start advocating for Johnny and

731
00:42:01.880 --> 00:42:05.239
asking for him to be granted clemency, so much so

732
00:42:05.400 --> 00:42:08.760
that Governor Ann Richards granted him a thirty day stay

733
00:42:08.800 --> 00:42:13.199
of execution an hour before his set execution date of

734
00:42:13.239 --> 00:42:17.840
January seventh, nineteen ninety two. These calls for clemency came

735
00:42:17.920 --> 00:42:22.360
directly from Amnesty International, Pope John Paul's Second, the Franciscan

736
00:42:22.440 --> 00:42:26.159
Sisters of Mary Immaculate of Amarillo, and the Bishops of Texas.

737
00:42:27.119 --> 00:42:30.039
In the Bishops of Texas statement, they said, quote, in

738
00:42:30.119 --> 00:42:32.559
the case of Johnny Frank Garrett, we believe that the

739
00:42:32.599 --> 00:42:35.639
court should take into consideration not only the fact that

740
00:42:35.679 --> 00:42:37.719
he was a juvenile at the time of the crime,

741
00:42:38.119 --> 00:42:40.679
but also that there is evidence not admitted in the

742
00:42:40.679 --> 00:42:43.880
previous court proceedings that he had separate brain damage, was

743
00:42:43.920 --> 00:42:46.920
abused as a child, and was addicted to drugs. He

744
00:42:47.039 --> 00:42:51.000
is now diagnosed as chronically psychotic and as the International,

745
00:42:51.039 --> 00:42:53.840
in their statements said, quote in light of the medical

746
00:42:53.840 --> 00:42:56.320
evidence of this case, referring to the abuse suffered by

747
00:42:56.400 --> 00:42:59.400
Johnny as a child, and the determination from a psychologist

748
00:42:59.480 --> 00:43:02.119
that interviewed him in nineteen eighty eight, who said that

749
00:43:02.159 --> 00:43:07.559
Johnny's case was one of the most virulent histories of

750
00:43:07.679 --> 00:43:10.119
abuse and neglect that he had ever encountered in over

751
00:43:10.159 --> 00:43:14.159
twenty eight years of practice. Amnesty International is concerned that

752
00:43:14.199 --> 00:43:17.440
Johnny Garrett's execution would be in violation of the United

753
00:43:17.519 --> 00:43:20.840
Nations Economic and Social Council resolution adopted in May of

754
00:43:20.920 --> 00:43:24.239
nineteen eighty nine, which recommends eliminating the death penalty for

755
00:43:24.360 --> 00:43:28.239
persons suffering from mental impairment or extremely limited mental competence.

756
00:43:28.760 --> 00:43:30.880
The little side note, how did they get all of

757
00:43:31.079 --> 00:43:34.480
How did they hear all about this evidence that wasn't

758
00:43:34.559 --> 00:43:39.079
used in trial? Like the bishops and whatnot?

759
00:43:39.360 --> 00:43:42.320
Who told them? Yes? I a psychiatrist had come out

760
00:43:42.639 --> 00:43:46.000
in nineteen eighty eight saying that he was chronically psychotic

761
00:43:46.079 --> 00:43:49.360
and severely abused. An appeal for clemency was made three

762
00:43:49.440 --> 00:43:52.199
times leading up to his execution, but the Supreme Court

763
00:43:52.320 --> 00:43:55.719
denied everyone, including the one made an hour before his

764
00:43:55.880 --> 00:43:59.559
new execution time. According to The New York Times, hearing

765
00:43:59.599 --> 00:44:01.960
had been inducted by the Texas Board of Pardons and

766
00:44:02.000 --> 00:44:05.760
Paroles to determine if Johnny's sentence should be commuted to life,

767
00:44:05.840 --> 00:44:09.480
but the board voted by seventeen to zero with one abstention,

768
00:44:09.719 --> 00:44:13.639
for the death sentence to stand. So on February eleventh,

769
00:44:13.719 --> 00:44:16.639
nineteen ninety two, Johnny Frank Garrett was put to death

770
00:44:16.679 --> 00:44:20.239
by a lethal injection. His last meal was ice cream,

771
00:44:20.280 --> 00:44:23.000
and his last words were allegedly quote, I'd like to

772
00:44:23.000 --> 00:44:25.280
thank my family for loving me and taking care of me.

773
00:44:25.480 --> 00:44:28.239
The rest of the world can kiss my ass. And

774
00:44:28.280 --> 00:44:31.039
I say allegedly because while this is widely regarded as

775
00:44:31.039 --> 00:44:34.719
his last words, they were never officially recorded, even though

776
00:44:34.960 --> 00:44:38.239
it was very strange because they usually last statements are recorded.

777
00:44:39.159 --> 00:44:42.679
But I looked on the like the Texas Department of

778
00:44:42.679 --> 00:44:45.400
Corrections for their death row inmates, everyone that had been

779
00:44:45.400 --> 00:44:47.199
put to death, it showed like if they had a

780
00:44:47.239 --> 00:44:49.519
last meal, what it was and what their last words were.

781
00:44:49.519 --> 00:44:50.960
And his last words were blank.

782
00:44:51.320 --> 00:44:55.880
So again there's serious doubt as to what was said.

783
00:44:56.360 --> 00:44:57.079
Oh what he.

784
00:44:56.960 --> 00:44:59.599
Said, Yes it but like I said, it is widely

785
00:44:59.599 --> 00:45:03.079
regarded that that is what he said. Now, this is

786
00:45:03.119 --> 00:45:06.159
not where the story ends. A lot of things occurred

787
00:45:06.199 --> 00:45:09.840
in the years after Johnny's execution, one of which was

788
00:45:09.960 --> 00:45:14.199
doctor Lph Erdman, the pathologist who didn't test the DNA evidence,

789
00:45:14.719 --> 00:45:16.639
ended up in a lot of trouble, which put a

790
00:45:16.639 --> 00:45:20.800
lot of the cases he assisted in in question. In

791
00:45:20.880 --> 00:45:24.360
nineteen ninety two, Erdmund was indicted on charges for falsifying

792
00:45:24.360 --> 00:45:27.840
an autopsy and accusations that he performed made to order

793
00:45:27.920 --> 00:45:32.960
autopsies for police. This sent defense attorneys into a frenzy

794
00:45:33.039 --> 00:45:35.480
looking to see if his work led to false convictions.

795
00:45:36.840 --> 00:45:40.320
According to the La Times, many prosecutors over the years

796
00:45:40.320 --> 00:45:44.440
had actually questioned doctor Erdman's bore habits and like literally

797
00:45:44.480 --> 00:45:46.599
someone said he didn't know his left from his right,

798
00:45:46.679 --> 00:45:50.719
like he was a mess, but they continued to utilize

799
00:45:50.760 --> 00:45:54.559
his expertise in court. At least twenty three of his

800
00:45:54.639 --> 00:45:57.840
cases in forty one counties were under review and bodies

801
00:45:57.840 --> 00:46:01.960
were exhumed to have them examined. Former Dallas County medical

802
00:46:02.000 --> 00:46:05.880
Examiner Linda Norton said, quote Erdmand routinely performs made to

803
00:46:06.000 --> 00:46:09.440
order autopsies that support a police version of a story.

804
00:46:09.559 --> 00:46:12.239
Some of Erdman's findings are so wrong as to be

805
00:46:12.400 --> 00:46:14.960
an insult to the intelligence of an average human being.

806
00:46:16.239 --> 00:46:19.400
It came out during this investigation that Erdman had lied

807
00:46:19.400 --> 00:46:22.840
about a variety of things during the conduction of different autopsies,

808
00:46:23.079 --> 00:46:26.039
including the weighing of a spleen and gallbladder of a

809
00:46:26.079 --> 00:46:29.880
man who after speaking with the family, it was learned

810
00:46:29.880 --> 00:46:33.280
that this man had those organs removed years before his death.

811
00:46:33.840 --> 00:46:36.760
He had also charged the county for an autopsy that

812
00:46:36.920 --> 00:46:41.079
pending an investigation was determined never happened, like they exumed

813
00:46:41.119 --> 00:46:43.559
the body and there were no incisions. Can't perform an

814
00:46:43.599 --> 00:46:45.519
autopsy unless you're cutting into somebody.

815
00:46:45.920 --> 00:46:47.639
But they continued to use this doctor.

816
00:46:48.079 --> 00:46:49.320
Well not after this.

817
00:46:49.920 --> 00:46:53.840
No, but prior to come on. Somebody had to have

818
00:46:54.320 --> 00:46:58.480
some sort of serious doubt on what he was doing

819
00:46:59.000 --> 00:47:01.360
prior to this time.

820
00:47:01.760 --> 00:47:04.800
Well, no one said anything. It was also learned that

821
00:47:04.840 --> 00:47:06.920
his wife had been receiving a lot of money from

822
00:47:06.960 --> 00:47:09.880
tissue and bone samples that came from the body's erdmin

823
00:47:10.000 --> 00:47:13.760
had autopsy that she was sending for donations, like she

824
00:47:13.840 --> 00:47:16.039
was sending them to body farms and stuff for research,

825
00:47:16.079 --> 00:47:18.760
and they were paying her when she wasn't ethically receiving

826
00:47:20.159 --> 00:47:23.639
these tissue samples and bones and things like that. It

827
00:47:23.760 --> 00:47:27.400
was also learns that he had lost the head of

828
00:47:27.440 --> 00:47:30.199
a murder victim. The murder victim had been shot in

829
00:47:30.239 --> 00:47:32.079
the head. He was supposed to send this head out

830
00:47:32.079 --> 00:47:35.800
for analysis or maybe even to extract the bullet, and

831
00:47:35.960 --> 00:47:40.000
he lost it, which led to the accused killer walking

832
00:47:40.079 --> 00:47:43.599
on the charges. Because no one to this day knows

833
00:47:43.639 --> 00:47:45.400
what happened to the head or how it was lost

834
00:47:45.440 --> 00:47:48.280
in the first place. And in fact he had turned

835
00:47:48.360 --> 00:47:54.599
up a body bones after like eight months of the

836
00:47:54.639 --> 00:47:57.599
police department, who are or the prosecution or whoever, going like,

837
00:47:57.639 --> 00:48:00.639
where's the body? We need the body and he goes, oh, no,

838
00:48:00.760 --> 00:48:04.039
here it is and the head that he put with

839
00:48:04.119 --> 00:48:07.719
the body belonged to a child or a young teenager.

840
00:48:08.760 --> 00:48:09.840
Because he didn't have the head.

841
00:48:11.039 --> 00:48:15.079
Nobody is saying, well, you have some serious issues here,

842
00:48:15.159 --> 00:48:16.280
like what is going on?

843
00:48:17.519 --> 00:48:22.000
And in response to all that, he did have his

844
00:48:22.039 --> 00:48:26.199
license revoked, big whoop, and he wasn't jailed, and I

845
00:48:26.239 --> 00:48:29.039
believe he had to pay a fine. His response was

846
00:48:29.039 --> 00:48:30.639
that people make mistakes.

847
00:48:32.360 --> 00:48:37.320
Seems like he's making mistakes or he made mistakes pretty frequently.

848
00:48:38.239 --> 00:48:42.199
Now, even though Erdmann was clearly making these massive mistakes,

849
00:48:42.400 --> 00:48:44.360
if you can call them them, and everyone knew it,

850
00:48:44.800 --> 00:48:47.880
no one bothered to take a second look at Johnny's case. Posthumously,

851
00:48:48.840 --> 00:48:54.159
it went it's fine. The pathologist that had basically the

852
00:48:54.159 --> 00:48:56.559
the evidence that sealed the deal quote unquote, even though

853
00:48:56.599 --> 00:49:00.440
it was never properly tested, has had his license from

854
00:49:00.480 --> 00:49:06.079
him for his unethical work and doing things in favor

855
00:49:06.119 --> 00:49:08.480
of the prosecution and the police. But you know, we're

856
00:49:08.480 --> 00:49:10.360
not going to look at the case that caused a

857
00:49:10.400 --> 00:49:12.599
seventeen year old to be put to death. We're not

858
00:49:12.599 --> 00:49:15.360
going to do that. Then, in two thousand and three,

859
00:49:15.840 --> 00:49:19.760
Potter County authorities re submitted the DNA evidence from Narnie Bryson,

860
00:49:19.920 --> 00:49:23.559
and they got a hint. The DNA belonged to Cuban

861
00:49:23.599 --> 00:49:27.599
refugee fifty five year old Leoncio Perez Roeda, who was

862
00:49:27.639 --> 00:49:32.559
on parole in New Mexico. Now Leonzio was this same

863
00:49:32.840 --> 00:49:37.000
exact man that police had arrested for peeping two weeks

864
00:49:37.039 --> 00:49:41.559
after Narnie's murder. Same guy. Additionally, the black hairs that

865
00:49:41.599 --> 00:49:46.079
were found at both scenes were confirmed to belong to Rueda,

866
00:49:46.519 --> 00:49:50.320
who it was learned, was friends with Fernando Flores, the

867
00:49:50.320 --> 00:49:54.199
man that police initially believed to have been Sister Toda's killer.

868
00:49:54.599 --> 00:49:57.320
At the time of Sister to DIA's murder, Leoncio was

869
00:49:57.360 --> 00:50:01.639
living with a Catholic family and receiving assistance Catholic family Services,

870
00:50:02.039 --> 00:50:07.360
which if you remember that professor said he believed that

871
00:50:07.440 --> 00:50:11.400
the person that committed these murders was not a native

872
00:50:12.000 --> 00:50:17.679
of Amarillo and had ties to Catholicism, whether they themselves

873
00:50:17.719 --> 00:50:21.559
were Catholic or not. He believed they were, but they

874
00:50:21.559 --> 00:50:25.480
had ties to Catholicism now. Leoncio also allegedly had been

875
00:50:25.480 --> 00:50:30.000
in contact with Sister Toda prior to the murder. Five

876
00:50:30.039 --> 00:50:33.719
months after his arrest, Leoncio spoke to Jesse Quackenbush, who

877
00:50:33.840 --> 00:50:37.079
was an attorney hired to clear Johnny's name by his family,

878
00:50:37.199 --> 00:50:40.480
and Leonsio told Jesse that he had sexually assaulted a

879
00:50:40.559 --> 00:50:43.480
nun at the orders of Fernando Flores. In fact, he

880
00:50:43.559 --> 00:50:48.440
did it to both women on Fernando's orders. However, Leoncio

881
00:50:48.679 --> 00:50:52.559
was only ever charged with one murder, that of Narnie Bryson,

882
00:50:52.719 --> 00:50:55.599
and he received forty five years in prison after taking

883
00:50:55.639 --> 00:50:58.400
a plea deal with the possibility of parole.

884
00:50:58.679 --> 00:51:03.679
And what happened to the other murder, they just said, oh, well,

885
00:51:03.719 --> 00:51:07.639
we've already executed somebody, so we don't have to do

886
00:51:07.679 --> 00:51:08.559
anything else with that.

887
00:51:09.320 --> 00:51:12.039
Yeah. Based on all of this, it's clear that Johnny

888
00:51:12.079 --> 00:51:14.159
Frank Garrett was put to death by some for something

889
00:51:14.159 --> 00:51:17.119
he probably didn't do. There is a theory that the

890
00:51:17.159 --> 00:51:20.159
clairvoyant made up the story about seeing Johnny in a

891
00:51:20.239 --> 00:51:23.079
vision because the police didn't have any leads and they

892
00:51:23.159 --> 00:51:26.400
used Johnny as a scapegoat because he was allegedly he

893
00:51:26.480 --> 00:51:29.079
was allegedly seen by a police officer the day before

894
00:51:29.119 --> 00:51:31.119
the murder beating a bush with a bat in the

895
00:51:31.119 --> 00:51:33.000
front yard, So I don't know if the police looked

896
00:51:33.000 --> 00:51:34.800
at him, and when he looks like he's trouble, we'll

897
00:51:34.800 --> 00:51:37.199
just blame it on him kind of thing. They just

898
00:51:37.239 --> 00:51:39.760
happened to kind of get lucky that he had reconnenced

899
00:51:39.800 --> 00:51:43.639
the convent. There's clearly a lot of misconducts and while

900
00:51:43.760 --> 00:51:47.239
Leoncio allegedly confessed sister to do his murder, the State

901
00:51:47.320 --> 00:51:49.880
of Taxes is not going to go back on the

902
00:51:49.920 --> 00:51:53.800
stance they've taken regarding Johnny. They made a big show

903
00:51:53.840 --> 00:51:56.280
of having their killer, even though they said from the

904
00:51:56.400 --> 00:52:00.280
very beginning that they believed one person was responsible both

905
00:52:00.280 --> 00:52:03.519
for both murders, and this person was a Keepan descent.

906
00:52:03.960 --> 00:52:07.719
There is a partition asking for a posthumist exoneration started

907
00:52:07.760 --> 00:52:10.480
by Johnny's sisters, and I hope that they get it.

908
00:52:11.519 --> 00:52:14.880
This case was just, i'll stay wrong from the get go,

909
00:52:15.719 --> 00:52:22.760
and nobody wants to take responsibility for all of the errors,

910
00:52:23.239 --> 00:52:28.320
all of the i'll say misconduct by the Medical Examiner's office.

911
00:52:29.320 --> 00:52:32.719
Him in particular, but nobody wants to take responsibility for that.

912
00:52:32.760 --> 00:52:35.679
They don't want to say, you know, we made a mistake,

913
00:52:36.199 --> 00:52:39.480
and we're sorry for the mistake that we made. What

914
00:52:39.519 --> 00:52:40.760
are they afraid of a lawsuit?

915
00:52:41.039 --> 00:52:41.199
You know?

916
00:52:41.440 --> 00:52:45.039
Is that the reasoning behind this. But you have another

917
00:52:45.320 --> 00:52:50.599
person that claimed or confessed to murdering both women, but

918
00:52:50.719 --> 00:52:53.239
you're not going to do anything about it.

919
00:52:53.639 --> 00:52:55.320
I don't think they want to admit they were wrong,

920
00:52:55.840 --> 00:52:58.480
and they cut corners to get an answer.

921
00:52:59.559 --> 00:53:02.719
It was from the prosecution side. It was wrong from

922
00:53:02.760 --> 00:53:07.519
the defense's side because all of this other evidence was

923
00:53:07.559 --> 00:53:11.679
never introduced. All of the doctors that had seen this

924
00:53:11.840 --> 00:53:17.440
young man and clearly said that he was suffering with

925
00:53:18.119 --> 00:53:24.920
all sorts of mental issues because of you know, the

926
00:53:25.000 --> 00:53:27.360
child abuse and the drug addiction and all of that.

927
00:53:28.119 --> 00:53:31.000
Both sides were wrong, and yet nobody's going to say,

928
00:53:31.119 --> 00:53:34.559
you know, we messed up. We shouldn't have done this,

929
00:53:36.039 --> 00:53:39.480
We should have been looking for the real killer, and

930
00:53:39.519 --> 00:53:42.519
this young man was put to death because it seems

931
00:53:42.559 --> 00:53:44.360
to me like they wanted an easy out.

932
00:53:44.760 --> 00:53:46.800
I think they did. I think they fully wanted an

933
00:53:46.800 --> 00:53:47.360
easy out.

934
00:53:47.760 --> 00:53:50.559
Say, look look at what we did. We found the murderer,

935
00:53:50.920 --> 00:53:53.559
but she did really, and this young man and his

936
00:53:53.599 --> 00:53:58.199
family have suffered because of the mistakes that were blatantly

937
00:53:58.239 --> 00:54:00.599
obvious and should have never happened.

938
00:54:01.800 --> 00:54:05.000
Absolutely, Like, it's rare, as I said, for me to

939
00:54:05.039 --> 00:54:09.760
cover a case where I doubts of an accused accused

940
00:54:09.760 --> 00:54:12.119
person's guilt. But it's even more rare for me to

941
00:54:12.159 --> 00:54:15.440
stumble upon a case like not actively searching for it

942
00:54:15.800 --> 00:54:18.440
where the accused is so clearly innocent. Once you start

943
00:54:18.480 --> 00:54:20.079
to dig a little deeper, because when you look at

944
00:54:20.079 --> 00:54:23.239
this case at face value, you just look at the

945
00:54:23.280 --> 00:54:27.280
court records and things like that, it's he obviously did it.

946
00:54:27.320 --> 00:54:29.360
But then you start digging and you realize, no, no,

947
00:54:29.440 --> 00:54:32.320
he didn't. None of this makes sense. None of it

948
00:54:32.360 --> 00:54:37.039
makes sense. Jesse Quackenbush actually made a like a documentary

949
00:54:37.159 --> 00:54:42.239
called The Last Word, and it's about Johnny's trial, about

950
00:54:42.679 --> 00:54:47.440
basically fighting for exoneration after the fact. There was also

951
00:54:47.480 --> 00:54:49.360
a movie that was needed. It's a horror movie. It's

952
00:54:49.360 --> 00:54:53.239
called Johnny Frank Garrett's Last Word and basically in the movie,

953
00:54:53.360 --> 00:54:56.039
Johnny Frank Garrett is put to death for murdering sister

954
00:54:56.119 --> 00:54:59.159
Tada Bens. They didn't change any of that, They just

955
00:54:59.239 --> 00:55:03.239
added that you he comes or his spirit has cursed

956
00:55:03.320 --> 00:55:05.880
the town and is going after everyone that lied. Basically

957
00:55:05.920 --> 00:55:09.079
a trial, which after the fact, looking back that that's

958
00:55:09.280 --> 00:55:13.079
quite satisfying to think about. But he didn't do it.

959
00:55:13.920 --> 00:55:16.800
He didn't do it. I there were I won't die

960
00:55:16.840 --> 00:55:18.400
on a lot of hills, but this is the hill

961
00:55:18.440 --> 00:55:19.000
I will die on.

962
00:55:19.280 --> 00:55:22.440
I blame you because it this would be something that

963
00:55:22.599 --> 00:55:25.599
would be, you know, like you want to jump on

964
00:55:25.639 --> 00:55:29.719
the bandwagon for you want to you know, stand on

965
00:55:29.760 --> 00:55:32.760
the soapbox and with the megaphone start screaming.

966
00:55:33.079 --> 00:55:35.880
The petition will be in the source notes who can

967
00:55:35.960 --> 00:55:39.840
sign it, also posted on Instagram, and it'll be on

968
00:55:39.840 --> 00:55:43.280
our website. But yeah, this this, this was this was

969
00:55:43.440 --> 00:55:45.760
this was a case. This was a full rabbit hole

970
00:55:45.840 --> 00:55:48.159
kind of case. For me. It wasn't supposed to be

971
00:55:48.239 --> 00:55:50.519
this long, It wasn't supposed to be this involved. And

972
00:55:50.559 --> 00:55:52.400
then I kept going and I realized that none of

973
00:55:52.400 --> 00:55:56.000
it made any sort of sense. And the website, there's

974
00:55:56.000 --> 00:55:58.400
a couple of websites that I believe are affiliated with

975
00:55:58.960 --> 00:56:02.719
Jesse Quackenbush, or at least the documentary that has the letters,

976
00:56:03.119 --> 00:56:08.079
the letters that Johnny wrote, the letter from his lawyer

977
00:56:09.719 --> 00:56:18.679
and the call for clemency from the Amnesty International and

978
00:56:18.800 --> 00:56:23.239
the Bishops of Texas will also be in the source notes.

979
